As for actually going to trial, I'm surprised too. But life always seems to amaze me. :) And as for moving it to a higher court, I'm not sure I know all of the facts, but according to Colorado law, it specifically states that no motions of any kind are allowed. The only way they could move it to a higher court is to countersue for more than $7,500. There was a mention of an appeal, but from what the court said, if any part wants to appeal, no new records can be submitted. The only thing that happens is the audio tape is reviewed by a second judge and makes sure the correct law was applied. I could be wrong about this.
