ASP - You are right of course MM about choosing your battles. But I shouldthink this one is easy to win. First off go and see a ChamberMagistrate or a solicitor at Legal Aid to clarify the situation - justprint out a copy of the agreement you signed? and get them to look at it.While I can see that they may have a right to seek the money for theorder, I cannot see how they can legally "fine" you for not paying thru ISFsDavidMM wrote: For me, it's not a case of being a muck. I'ts a matter of choosing my battles, based upon the amts involved and how much time, money and energy will be required of me, and not necessarily based on how pi~~ed off I am. What will the payoff be and how much will the pursuit impact my business at hand, which is my lifeblood.? I have battled before and have won judgements, but in the larger scheme of things, I have lost by losing time that would have been better spent in more productive, useful and financially rewarding ways. Additionally, in this case, I am unclear as to my actual legal position. When I setup the acct w/ the service that I made the purchase from, I accepted the terms of an agreement which allows them to collect from me through, essentially, any means necessary. I didn't explicitly give rights to either company- particularly the collection agency, who's late submittals to the bank for collecting their fees, (seperate from the purchase amts), is what really caught me off guard and is responsible for the esallated increase in fee amts. I don't know whether or not I opted into giving them this right when I agreed to the acct terms when signing on w/ the company providing me w/ the services. The actions may be unethical, but are they illegal? The banks terms may be a modern form of usury, but are they illegal? Do I want to spend the time researching this or is it worthwhile to pay an attorney to interpret what is unclear to me? Unless someone can demonstrate to me that this situation is, legally, a clearcut case, and/or that there is a direct path to gaining restitution, (which was what I had hoped for, although I was not expecting it), than I see getting tied up w/ this battle as being counterproductive, and feel it would just be better to pass. IMO, it's wrong, I'm getting screwed, and I'm p~~~ed- just don't want to give them any more by letting them suck more energy out of me than they already have. PS If it is just a matter of shooting off a couple of emails and filing a complaint(s), I am down for that, but I don't know the ropes.--If we're not supposed to eat animals, why are they made out of meat?
